1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Build Believe Fit LLC website at buildbelievefit.fitness, the BBF Client App, in-person and remote coaching services, and all in-app agentic tools including Sovereign Phantom Eye, Virtual Coach, Nutrition Vision, and Chef on Call (collectively, the "Services"). By accessing or using the Services, by paying for a subscription, or by clicking any "I agree" or equivalent affirmation, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
2. Eligibility
You must be at least eighteen (18) years of age to use the Services. By using the Services, you represent and warrant that you are eighteen or older, that you have the legal capacity to enter into a binding contract, and that you are not barred from using the Services under the laws of the United States or your jurisdiction of residence.
3. Description of Services
Build Believe Fit LLC provides:
- Coaching services — in-person and remote personal training, programming, and accountability protocols.
- The BBF Client App — a web application for tracking workouts, nutrition, and recovery.
- Agentic AI tools — live, AI-assisted features that may include real-time form analysis (Phantom Eye), audio coaching (Virtual Coach), food and meal analysis (Nutrition Vision), and nutrition consultation (Chef on Call).
- Nutrition planning — AI-generated meal protocols filtered against the dietary profile and allergen restrictions you provide.
We reserve the right to modify, suspend, or discontinue any portion of the Services at any time, with or without notice.
4. Account & Security
To access most features, you must create or be provisioned a client account with a unique username and PIN. You are responsible for:
- Maintaining the confidentiality of your credentials.
- All activity that occurs under your account.
- Notifying us immediately at akeem@buildbelievefit.fitness if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms, that pose a security risk, or that are inactive for extended periods.
5. Subscriptions, Payments & Billing
Certain Services require a paid subscription or one-time payment. By subscribing, you authorize us (or our payment processor, Stripe) to charge the payment method you provide on a recurring basis until you cancel.
- Billing cycle — monthly or annual, as selected at checkout.
- Auto-renewal — subscriptions renew automatically at the then-current rate unless canceled before the renewal date.
- Price changes — we will provide reasonable notice of any pricing changes before they take effect.
- Failed payments — we may suspend access if payment fails and is not cured within seven (7) days of notice.
6. Refund Policy
All subscription fees are billed in advance and are non-refundable except where required by law. If you cancel mid-cycle, you retain access through the end of the paid period; we do not pro-rate refunds for unused time. One-time programs and packages purchased outright are non-refundable once content or services have been delivered.
If you believe a charge was made in error, contact akeem@buildbelievefit.fitness within fourteen (14) days of the charge. We review all good-faith requests on a case-by-case basis.
7. Acceptable Use
You agree NOT to:
- Use the Services for any illegal, harmful, or fraudulent purpose.
- Share your account credentials with any other person.
- Reverse engineer, scrape, copy, or attempt to derive the source code of the Services.
- Use the agentic AI tools to generate content for redistribution outside your personal training context.
- Interfere with, disrupt, or attempt to gain unauthorized access to any portion of the Services.
- Submit knowingly false health or intake information that could compromise the safety of your program.
- Use the Services to harass, abuse, or harm another person.
8. Health & Fitness Disclaimer
The Services do not constitute medical advice. Build Believe Fit LLC is a coaching, training, and educational service. We are not a healthcare provider. The training programs, nutrition plans, form-check observations, and AI-generated recommendations we provide are not a substitute for professional medical advice, diagnosis, or treatment.
Consult your physician before beginning any exercise or nutrition program, especially if you have any pre-existing condition, injury, pregnancy, or are taking medications that may affect your ability to exercise safely.
You acknowledge that physical exercise carries inherent risks, including risk of injury or, in rare cases, more serious harm. You voluntarily assume those risks and agree that you are responsible for monitoring your own physical condition, stopping or modifying any exercise that causes pain or distress, and seeking immediate medical attention when warranted.
AI-generated guidance — Outputs from Phantom Eye, Virtual Coach, Nutrition Vision, Chef on Call, and the AI Auto-Rotate Protocol are produced by machine learning systems and may contain errors, omissions, or outdated information. Always use your own judgment, and when in doubt, escalate to a qualified human professional.
9. SMS / Text Message Terms
If you provide your mobile number on the Pathfinder intake form or any other opt-in surface, you consent to receive text messages from Build Believe Fit LLC at that number, delivered via our SMS provider, Twilio. Message types include:
- Transactional notifications (account credentials, appointment reminders).
- Coaching follow-up and check-ins.
- Re-engagement when an intake is started but not completed.
Message frequency varies. Message and data rates may apply. Reply STOP at any time to unsubscribe. Reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.
Mobile information sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Sharing is limited to subprocessors that directly support the Services (Twilio for delivery). This carve-out applies to all SMS opt-in data.

10. Intellectual Property
All content on the Services — including text, graphics, logos, training programs, meal plans, video, audio, software, and the Sovereign Fuel Matrix — is the property of Build Believe Fit LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial use during the term of your active subscription. You may not reproduce, distribute, publicly display, sell, or create derivative works from any Services content without our prior written consent.
11. User-Provided Content
You retain ownership of personal information, photos, video, audio, or other content you submit to the Services ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free license to use, store, reproduce, and process that content solely for the purpose of operating the Services, including transmitting your audio and camera feed to AI subprocessors during live coaching sessions.
You represent and warrant that you have all necessary rights to submit your User Content and that doing so does not violate any third party's rights.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, including for violation of these Terms. You may cancel your subscription at any time from your client portal or by contacting us. Upon termination, your right to access the Services ends immediately, though we may retain your data as needed to comply with legal obligations or as outlined in our Privacy Policy.
13. Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
- Build Believe Fit LLC and its officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
- Our total cumulative liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.
14. Indemnification
You agree to defend, indemnify, and hold harmless Build Believe Fit LLC and its officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Services; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third party's rights.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State in which Build Believe Fit LLC is registered, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will first be addressed through good-faith informal negotiation. If unresolved within thirty (30) days, the dispute will be submitted to binding arbitration on an individual basis, except that either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property or confidential information. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Build Believe Fit LLC regarding the Services and supersede any prior agreements between us on this subject. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
